Slip and Fall in a Big Box Store? Avoid These 3 Mistakes That Could Cost You

Oct 03 2025

If you’ve ever experienced a slip and fall in a big box store like Walmart, Costco, or Target, listen up. Before you even reach your car, the store’s legal team is already working to protect their interests. One wrong move on your part could mean missing out on compensation for your injuries or even ending up stuck with the medical bills.

I’m here to share the three most common mistakes I see after a slip and fall in a major retail store and how you can avoid them. These small actions can make a huge difference in your ability to recover both physically and financially.

Mistake #1: Not Reporting the Slip and Fall Right Away

This happens more often than you’d think. People slip and fall, feel embarrassed, and just walk out. But failing to report what happened can seriously hurt your chances of getting help later.

Take one of my clients, for example. She slipped on a spilled drink near the entrance of a store. There was no warning sign, and she was clearly shaken up. She assumed she’d be fine and left without telling anyone. Two days later, she could barely walk. When we reached out to the store, their response was simple: “We have no record of that ever happening.”

If you don’t report your slip and fall, the store can deny it ever occurred. Always ask for a manager and report what happened. If they fill out an incident report, ask for a copy or snap a photo of it. Even a quick note on your phone with the date and time can help.

Mistake #2: Not Gathering Your Own Evidence

Most stores have security cameras, but they do not always save footage for long. In some cases, the footage gets deleted within days. Do not count on them to preserve the evidence for you.

One client slipped on a broken tile in a home improvement store. The sharp edge of the tile was partially hidden by a product display. She hit the ground hard but managed to take pictures of the tile, her arm, and the surrounding area. That photo ended up being the key to her case.

If you slip and fall, take photos of what caused it and any injuries you sustained. Look around and see if anyone witnessed the fall. A simple question like “Did you see that?” and asking for their name or phone number can go a long way later on.

This is not about being dramatic. It is about protecting yourself in case things get worse.

Mistake #3: Delaying Medical Treatment

When you slip and fall, adrenaline can make it feel like no big deal at first. But waiting too long to see a doctor can seriously damage your case. The store’s insurance team may use that delay against you, arguing that your injuries must not have been serious.

I once had a client who waited five days before seeing a doctor after a fall at a wholesale club. He ended up with a concussion and a torn ligament. But because he did not seek treatment right away, the store tried to claim he could have been injured somewhere else.

Even if you feel okay after a fall, get checked out. Injuries like concussions, soft tissue damage, or internal bruising often do not show symptoms right away. Early medical documentation helps your health and gives your claim a solid foundation.

Protect Yourself Before It’s Too Late

If you slip and fall in a big box store, speak up immediately. Take a few photos. See a doctor even if you think you’re fine. These simple steps are not just about building a personal injury case, they are about making sure you get the care and support you need.

If this has already happened to you and you’re not sure what to do next, don’t panic. Every situation is different, and I can help you understand where you stand. There is no pressure and no judgment, just the guidance you need.
